Terms of Service

CaQeh does not move, hold, safeguard, or take custody of customer funds, and it does not operate as a payment service provider, bank, or money transmitter. Please read these Terms carefully before using the marketplace.

1. Acceptance of Terms

By accessing or using the CaQeh platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1A. Platform operator

The CaQeh platform is managed and operated by TAXEL TECHNOLOGIES LIMITED (Uganda), trading as Taxel Tech. Tax Identification Number (TIN): 1056941573. URSB Certificate Number: 80034589548817. Company website: taxeltech.com. References to “CaQeh,” “we,” or “us” in these Terms mean TAXEL TECHNOLOGIES LIMITED operating the CaQeh brand and Service.

2. Description of Service

CaQeh is a peer-to-peer liquidity marketplace and technology platform that connects users seeking to complete payments using existing licensed payment rails, including mobile money services, banks, and card networks. Rather than moving, holding, or safeguarding customer funds, CaQeh facilitates the matching of participants so transactions can be completed through regulated financial institutions and payment providers. The platform does not take custody of customer funds or operate as a payment service provider, bank, or money transmitter. All payments are executed over the applicable licensed payment infrastructure in accordance with the terms and requirements of the relevant financial service providers.

2A. Payment Provider Relationship

CaQeh may present payment-method information, facilitate participant matching, and record marketplace status information. A user authorizes and completes any payment directly with the applicable licensed financial institution or payment provider. The provider's account terms, authorization requirements, fees, availability rules, dispute procedures, and applicable law govern that payment.

3. Eligibility

You must be at least 18 years old and legally permitted to use financial services in your jurisdiction. You must complete identity verification (KYC) to access full features, higher limits, or agent mode.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must not share your login information. Notify us immediately of any unauthorized access.

5. Transactions

CaQeh does not receive, hold, safeguard, transmit, release, reverse, or settle customer funds. Participants are responsible for reviewing payment details and completing payments through their chosen licensed providers. Any platform fee is disclosed before use of the relevant marketplace feature; provider fees and payment outcomes are governed by the provider's terms and applicable law.

6. Cash Agent Obligations

Cash agents must maintain accurate availability status, honor quoted fees, and complete exchanges promptly. Agents who fail to meet these obligations may be suspended.

7. Prohibited Activities

You may not use the Service for money laundering, terrorist financing, fraud, or any illegal activity. CaQeh monitors transactions for compliance with applicable laws and regulations.

8. Fees

Any applicable marketplace fee is displayed before you use the relevant feature. Fee rates may vary by marketplace feature and amount. The applicable licensed provider may charge separate fees under its own terms.

9. Disputes

If a dispute concerns use of the CaQeh marketplace, either party may report it through the platform. CaQeh may review the report and take action on access to the marketplace. Disputes about a payment, including authorization, processing, reversal, or funds, must be addressed through the applicable licensed financial institution or payment provider and its procedures, without limiting rights that cannot be waived under applicable law.

10. Limitation of Liability

CaQeh facilitates marketplace matching and is not a party to, and does not process, the payment between participants. The applicable licensed financial institution or payment provider is responsible for payment execution under its own terms. We are not liable for losses arising from user error, provider action or downtime, unauthorized account access, or force majeure events. Our total liability is limited to the platform fees collected for the disputed marketplace feature, except where prohibited by law.

11. Governing Law

These Terms are governed by the laws of the Republic of Uganda, without regard to conflict-of-law principles, except where mandatory consumer protections of your country of residence cannot be waived. Courts in Kampala, Uganda have exclusive jurisdiction over disputes arising from these Terms, subject to any non-waivable rights to bring claims in your local courts.

12. Modifications

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via notification.
